Antony Weston (36) of Ryde, Isle of Wight has been awarded compensation of £2,700 after he tripped and fell on a badly lit path while on holiday in Zakynthos.
Mr Weston went on holiday to the Justina Apartments, Tsilivi, Zakynthos with Tour Operator Manos Holidays from 6 to the 20 October 2002. His accident occurred on 10 October, during the first week of his holiday, leaving him with a fractured ankle. The injury was sustained as Mr Weston was walking back to his apartment, along the only pathway available to him when he fell down a hole.
He knew that there was no lighting on the path and the Tour Operator had advised him to take a torch although he did not do this. Mr Weston was also aware that the ground was uneven and just before the accident, even advised his fiancé to take extra care!
In April 2003, Mr Weston got in touch with Holiday Claim Line, a specialist legal service run by Derbyshire-based CS2 Lawyers. This month (June), the claim was settled with liability on a 65/35 basis in favour of Mr Weston and he was awarded £2,700 compensation without the need for court proceedings.
Claire Grayson, Solicitor at CS2 said that Mr Weston’s case is not unusual, “Even if someone is partly to blame for their accident and injuries, they may still be able to pursue a successful claim against the Tour Operator.”
