Chesterfield-based CS2 Lawyers recently helped four people whose dream holidays were ruined to win more than twice the amount of compensation originally offered by their tour operator.
Geoff and Marlene Scarr from Swindon had booked the holiday in Barbados to celebrate Mr Scarr’s 50th birthday. Also booked into the same hotel – the Almond Beach Club - were Peter and Hilary Hall from Esplanade, Isle of Wight who were celebrating their 25th wedding anniversary.
In total, the couples had spent £6,000 on their dream holidays and were looking forward to celebrating in style. However, on arrival they were told that there was no booking in their names and they had an embarrassing wait at the hotel check-in desk while the problem was dealt with.
For the whole of the first week of their holiday, the couples suffered the uncertainty and the worry that that they would be moved to alternative accommodation. For the second week of the holiday, the couples were moved to alternative accommodation which did not have a spa and was a family resort – the two main reasons why they had booked to stay in the Almond Beach Club.
Mrs Scarr and Mrs Hall had also booked and paid for spa treatments at the Almond Beach Club which they were not able to get a full refund for. This resulted in them having to travel to the hotel to make use of these treatments.
Although tour operator Moresand, admitted liability at the beginning of the claim, they only offered £1,500 in compensation to the couples. However, the couple had contacted CS2 Lawyers’ Holiday Claim Line. With the backing of CS2’s specialist travel lawyers, the Scarrs and the Halls took the case to court and recently won a greatly increased compensation award of £4,000 from Moresand.
